On October 21, 2022, the so-called Democratic Memory Law came into force in Spain, which expanded the possibility of obtaining Spanish citizenship for grandchildren of Spaniards.<\/p>\n

In summary, the law allows (i) those born outside of Spain, whose father, mother, grandfather, or grandmother was born in Spain, but lost or renounced nationality due to exile for political, ideological, religious, or sexual orientation and identity reasons; (ii) sons or daughters of Spanish women who lost their nationality by marrying foreigners before the entry into force of the 1978 Constitution; or, (iii) sons and daughters over 18 years of age of Spaniards who had their nationality of origin by exercising the right of option provided for in the Democratic Memory Law or the Historical Memory Law (52\/2007).<\/p>\n

After the law came into force, the Spanish Ministry of Justice expressed the possibility that the right of option could also be exercised by grandchildren of Spaniards who maintained their nationality, that is, the faculty would be extended to grandchildren of Spaniards, without distinction.<\/p>\n

It is important, however, to emphasize that the request must be made by October 20, 2024, and the deadline may be extended for another year by the Council of Ministers.<\/p>\n
